1. Parties
This Rental Agreement ("Agreement") is entered into between SaugaCityRentals ("Company", "we", "us") and the renter named below ("Renter", "you"). By signing, Renter agrees to all terms below.
2. Driver Requirements
Renter must be at least 25 years old, hold a valid full Class G (or equivalent) driver's licence for a minimum of 3 years, and provide a clean driving abstract upon request.
Only the named Renter (and pre-approved additional drivers listed on this Agreement) may operate the vehicle. Unauthorized drivers void all coverage.
3. Insurance & Liability
Renter must provide proof of valid auto insurance with comprehensive and collision coverage in their own name, or purchase coverage arranged through the Company prior to pickup.
Renter is fully responsible for any damage, loss, theft, fines, tolls, parking infractions, traffic violations, and impound or recovery fees incurred during the rental period, regardless of fault.
4. Security Deposit
A refundable security deposit is pre-authorized on Renter's credit card at pickup. The amount varies by vehicle (typically $2,500–$10,000) and is released after the vehicle is returned and inspected, less any damages, fees, or charges.
5. Mileage & Fuel
Daily rentals include 200 km/day. Hourly rentals include 25 km/hour. Overage is billed at $5.00/km.
Vehicles are delivered with a full tank and must be returned full. Refueling fee is $8.00/L plus a $75 service charge.
6. Permitted Use
Vehicle may not be used: (a) for racing, track events, off-road, or competitive driving; (b) to transport passengers or goods for hire; (c) under the influence of alcohol, cannabis, or any impairing substance; (d) outside Ontario without prior written consent; (e) to tow any trailer or load.
Smoking and vaping inside the vehicle are strictly prohibited. A $500 cleaning fee applies to violations.
7. Damage, Loss & Recovery
Renter agrees to pay full repair cost, diminished value, loss-of-use, towing, storage, and administrative fees for any damage caused during the rental period. Damage is assessed by an independent appraiser whose decision is final.
In the event of theft or total loss, Renter is liable for the full retail replacement value of the vehicle, less insurance proceeds actually received by the Company.
8. Cancellation Policy
Cancellations made more than 72 hours before pickup receive a full refund. Within 72 hours: 50% charge. Within 24 hours or no-show: 100% charge. Weather, traffic, and personal scheduling conflicts are not eligible exceptions.
9. Late Returns
Returns more than 30 minutes past the scheduled return time are billed an additional hour at the hourly rate. Returns more than 4 hours late are billed a full additional day.
10. Indemnification
Renter agrees to indemnify and hold harmless the Company, its owners, employees, and partners from any claims, damages, losses, or expenses (including legal fees) arising out of Renter's use of the vehicle.
11. Governing Law
This Agreement is governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes shall be resolved exclusively in the courts of Ontario.
12. Electronic Signature
By typing your full legal name and checking the acceptance box below, you agree this constitutes a legally binding electronic signature equivalent to a handwritten signature under the Ontario Electronic Commerce Act, 2000.
